Inventory - John Bain Esq
Will
Follows Disposition and Settlement of John Bain of Morriston
residing at Huntingdon Cottage Bridge of Allan
Considering that I have already provided for my children
to the best of my ability and being now desirous and resolved to
settle the remainder of my means and estate and affairs generally
so as to prevent disputes after my death in regard to my succession
Do hereby give grant assign dispose and convey to and in favour
of Wilhelmina Turnbull or Bain my wife residing with me in the event
of her surviving me and her heirs and assigness whomsoever All and
sundry lands and heritages debts heritable and moveable and whole
goods gear debts sums of money furniture and effects including Railway
and other stocks and shares and generally the whole estate and effects
heritable and moveable real and personal of every description now
belonging or which shall pertain and belong to me at the time of
my death with the whole writs titles vouchers and securitites thereof
and all that has followed or may be competent to follow thereon
with power to the said Wilhelmina Turnbull or Bain and her foresaids
to call and pursue for uplift and discharge the debts goods and
effects hereby conveyed and generally to do everything in relation
to the premises which I might have done before granting hereof But
always with and under the burden of my first and lawful debts funeral
expenses and of such gifts or legacies as I may think proper to
leave by any deed to be hereafter executed by me and I hereby nominate
and appoint the said Wilhelmina Turnbull or Bain to be my sole Executrix
and universal legatory excluding all others therefrom Proving always
and declaring that in the event of my said Lands of Morriston and
Rosebank being taken possession of and sold by the said Wilhelmina
Turnbull or Bain or by the heritable creditors vested therein and
producing a sum more than sufficient to pay the heritable debts
secured there on interest and expenses of sale. I direct and appoint
my said Disponce to pay and deliver to my son William Edward Bain
the free balance or surplace of the price if any that may remain
from the sale of said lands And I reserve my own liferent of the
estate and effects before conveyed and power to me at any time of
my life to alter or revoke there presents as I may think proper
But declaring the same in so far as not altered or revoked by me
shall be a valid and effectual deed wheresoever found at the time
of my death and I dispense with the delivery hereof and revoke all
deeds of a testamentary nature executed by me prior to the date
hereof and I consent to the Registration hereof for presentation
and execution
In witness whereof
these presents written on this and the preceeding page by Joseph
Adam Clerk to John Kerr Writer in Glasgow are subscribed by me at
Glasgow the seventeenth day of August Eighteen hundred and sixty
eight before these witnesses the said John Kerr and Joseph Adam.

produced and gain in to whereof the tenor follows:
Inventory of
the personal estate wheresoever situated of John Bain of Morriston
who resided at Bridge of Allan & who died there on the twentieth

At Glasgow
the sevent day of March Eighteen hundred and seventy in presence
of Archibald Galbraith one of her Majestys Justces of the Peace
for the County of Lanark Appeared Wilhelmina Turnbull or Bain residing
at Bridge of Allan, relict of the late John Bain of Morriston who
resided at Brdge of Allan, who being solemnly sworn and examined
depones that the said John Bain died at Bridge of Allan upon the
twentieth day of December Eighteen hundred and sixty nin, and the
deponent has entered upon the possession and management of the deceaseds
personal estate as sole executive nominated by him in a Disposition
and Settlement executed by him upon the seventeenth day of August
Eighteen hundred and sixty eight, which is now echibited and signed
by the Deponent and the said Justice of Peace of this date as relative
here to : That the Deponent does not know of any testamentary settlement
or writing relative to the disposal of the deceaseds personal estate
or effects or any part thereof, other than the said disposition
and settlement: That the foregoing inventory signed by the Deponent
and the said Justice of Peace as relative hereto is a full and complete
Inventory of the Personal Estate and Effects of the said deceased
John Bain wheresoever situated and belonging or due to him beneficially
at the time of his death in so far as the same has come to the Deponents
knowledge that the Deponent does not know of any money or property
belonging to the deceased liable to the duty imposed by the Acts
23 Vict.C15 and 23 and 23 Vict C 80: That the value at this date
of said personal estate and effects situated in Scotland including
the proceeds accrued thereon down to this date in Eight hundred
pounds sterling and under one thousand pounds sterling: That confirmation
of the said Personal Estate is required in favour of the Deponent.
All which is truth as the Deponent shall answer to God
