LAST WILL & TESTAMENT
OF JOSEPH HARDIE SNR.
I JOSEPH HARDIE of Paparoa
In the Provincial District of Auckland In New Zealand Farmer.

Revoke
all wills at any time made by me and declare this to be my last
will.
|
| 2. |
Appoint
my wife Matilda in case she shall survive me sole executor and
Trustee of this will until her decease provided that after her
death or in case she shall not survive me I appoint my two sons
James and David to be the executors and trustees of this my
will.

| 3. |
Direct
that all my just debts funeral and testamentary expenses shall
be paid.
|
| 4. |
Give
to my adopted daughter Jane Helen Mackwood or Hardie four hundred
pounds sterling.
|
| 5. |
Devise
and bequeath all my real property and the residue of my personal
property unto the executor or executors for the time being of
this my will (hereinafter called 'my executors') upon trust
to hold the same in trust for my said wife during her lifetime
without impeachment of waste and after her death upon trust
to divide my said residuary estate equally amongst my seven
children Annie, Christina, Edward, David, James, Carrie and
Joseph

Direct
that in case any of my said last mentioned seven children shall
predecease me and my said wife leaving issue living at the death
of the survivor of myself and wife such issue shall divide equally
the share which their parent would have received if such parent
had survived my wife and myself.

Direct
that in case any of my said seven natural children shall die
before my wife and myself without leaving issue such childs
share shall be divisible equally between my other said children
then living and the surviving children of any other deceased
child or children of mine. Provided however that the issue of
any deceased child of mine shall take equally between them only
the share which their parent would have taken if the latter
was then living.

I empower
my executors to sell or otherwise deal with my real and residuary
personal estate and any part or parts thereof at such times
and in such manner In all respects without being responsible
for loss as they shall in their uncontrolled discretion think
best. |
IN WITNESS WHEREOF I-have
hereunto subscribed my name this second day of February one thousand
nine hundred and seventeen.
