Open
Access License
The
Multi-Axial Modular Organizational Survey (MAMOS) is protected by
copyright law. The copyright belongs solely to Dr Jeffrey Clayton Patrick
(Jeff
Patrick) of Brisbane Australia as of November 2002. Nothing in this
Open Access License (license) is intended to reduce, limit, or restrict
any rights arising from fair use, or other limitations on the exclusive
rights of the copyright owner under copyright law. All rights to the MAMOS
are reserved by the Jeff Patrick, except as specifically described below.
Jeff Patrick grants the International, non-exclusive, and perpetual right
to all persons or legal entities (the licensee) to duplicate, modify,
distribute, and use the MAMOS without financial consideration of any kind
(freely) only as long as they adhere to all seven conditions (terms)
listed in this license. By duplicating or modifying or distributing or
otherwise using the MAMOS, the licensee confirm that they accept and agree
to be bound by the terms of this license. Jeff Patrick permanently
withdraws all rights given under this license from all persons or legal
entities who fail to comply with all the terms of this license. Those
persons or legal entities that breach this license agreement may fully
satisfy any liability to Jeff Patrick by individually notifying in writing
any person or legal entity that may have been or may be affected by the
breach. Jeff Patrick is deemed to be affected by all breaches, and should
therefore also be notified. All notifications of breaches should detail
the nature and full extent of the breach.
Terms:

The
licensee nor those persons or legal entities acting on their behalf may
not seek or receive any financial income directly for the MAMOS in any
form. The MAMOS and any modified version of the MAMOS may only be
offered freely. This condition does not preclude the licensee charging
fees for related services that may include modification of the MAMOS,
administration of a survey, printing of the survey, electronic
programming of the survey, hosting of the survey, data entry, data
scoring, interpretation of the MAMOS, provision of comparative data, the
production of associated reports, the provision of educational programs
that may be wholly or part about the MAMOS, and any other presentations
and organizational development services that may in part arise from the
use of the MAMOS.

Jeff
Patrick does not offer any endorsement or warrantees whatsoever in
relation to the MAMOS or any modified version of the MAMOS.

The
licensee agrees that except to the extent required by law, Jeff Patrick
is not liable for any damages arising out of this license or the use of
the MAMOS, even if Jeff Patrick has been advised of the possibility of
such damages. The licensee alone bears sole liability for the use of the
MAMOS and any modified version of the MAMOS.

The
licensee agrees that this license carries forward to any modified
version of the MAMOS, and that this license must in full accompany any
modified version. The licensee may denote their version of the MAMOS by
modifying the title of the survey. The modified title must begin with
the acronym “MAMOS”, end with the word “version” (e.g. “MAMOS –
[Licensee Name and Year] version”).

The
licensee must include a copyright notice on every copy of the MAMOS or
modified version of the MAMOS they may provide (“Copyright © Jeff
Patrick 2002, provided under the Open Access License”). The licensee
must also make a full copy of this license available on request to any
person who may be given access to the MAMOS or any modified version of
the MAMOS.

If any
part of this license is invalid under law, it shall not affect the
validity of the remainder of the license, and without further action by
the parties to this agreement, such provision shall be reformed to the
minimum extent necessary to make such provision valid.

The
licensee may not modify this license in any way. The licensee may not
impose any further restrictions on the MAMOS or any modified version of
the MAMOS beyond those restrictions described in this license.
This
license constitutes the entire agreement between Jeff Patrick and the
licensee with respect to the MAMOS. There are no understandings,
agreements or representations with respect to the MAMOS not specified in
this license. Jeff Patrick shall not be bound by any additional provisions
that may appear in any communication from the licensee.
